This Liability Waiver ("Waiver") applies to all users of the CondoGrid platform, including developers, brokers, agents, clients, and any party accessing or relying on data, analytics, or materials provided through CondoGrid.
By accessing or using CondoGrid, you acknowledge and agree to the terms below.
1 No liability for developer content
All project information displayed on CondoGrid — including pricing, availability, renderings, floor plans, timelines, incentives, and written descriptions — is provided directly by developers or their representatives.
CondoGrid:
- Does not verify accuracy
- Does not audit developer-provided content
- Does not update information unless provided by developers
- Is not responsible for project changes, inaccuracies, delays, or misrepresentations
Developers are solely responsible for all content they upload.
2 No liability for real estate decisions
You agree that:
- CondoGrid does not provide real estate advice
- CondoGrid does not represent buyers or sellers
- CondoGrid does not act as a brokerage for your transactions
- CondoGrid does not guarantee the quality, value, or completion of any development
- CondoGrid is not responsible for contract disputes or negotiations
- You must independently verify all property information before making decisions
Any decision to inquire, invest, purchase, or promote a project is entirely at your own risk.
3 No liability for market performance
CondoGrid does not guarantee:
- Reservations
- Sales
- Conversions
- Market demand
- Lead volume or quality
- Broker performance
- Developer performance
- Profitability
- Return on investment
You waive the right to hold CondoGrid responsible for business outcomes.
4 No liability for analytics, metrics, or data
CondoGrid provides analytics and engagement metrics for informational purposes only.
You acknowledge that:
- Metrics may contain errors
- Analytics are estimates and not guarantees
- Engagement does not guarantee leads or sales
- Impressions and views may fluctuate
- User behavior varies and is unpredictable
You agree not to rely solely on CondoGrid analytics for critical business decisions.
5 No liability for platform behavior
You understand that use of CondoGrid may involve:
- Downtime
- Technical glitches
- Data processing delays
- Bugs or errors
- Incomplete features
- Changes to platform functionality
CondoGrid is provided "AS IS" and "AS AVAILABLE."
You waive any claim arising from:
- System outages
- Slow loading times
- Lost messages
- Failed uploads
- Feature changes
- API limits or failures
6 No liability for data loss
Although CondoGrid uses reasonable security measures, you acknowledge that:
- Cloud systems may fail
- Data may corrupt
- Files may be lost
- User actions may cause loss
- Backups may not be available
You agree to maintain your own copies of critical data.
CondoGrid is not liable for loss, corruption, or recovery of any data.
7 No liability for third-party services
CondoGrid integrates or interacts with third-party services, such as:
- Hosting providers
- Email/SMS gateways
- Analytics platforms
- CRM tools
- Authentication systems
- Payment processors
CondoGrid is not liable for:
- Outages
- Errors
- Data breaches
- Failures
- Delays
- Actions performed by third parties
Your use of third-party tools is at your own risk.
8 Limitation of liability
To the fullest extent permitted by law:
- CondoGrid's total liability for any claim is capped at the fees you paid in the last 3 months
- CondoGrid is not liable for indirect, punitive, incidental, special, or consequential damages
- CondoGrid is not liable for lost commissions, lost business, or lost opportunities
- CondoGrid is not liable for developer disputes or project-specific issues
This limitation applies whether the claim arises from:
- Contract
- Tort
- Negligence
- Strict liability
- Or any other legal theory
9 Indemnification
You agree to indemnify, defend, and hold harmless CondoGrid from claims arising out of:
- Your actions or omissions
- Inaccurate content you upload
- Misuse of project materials
- Violations of real estate or advertising laws
- Infringement of third-party rights
- Reliance on inaccurate data
- Disputes between brokers and developers
- Property or contract disputes
This survives termination of your CondoGrid account.
10 Agreement to arbitration
All disputes arising under this Waiver shall be resolved by binding arbitration in Miami-Dade County, Florida, as outlined in the main Terms & Conditions.
No lawsuits. No jury trials. No class actions.
11 Acknowledgment
By using CondoGrid, you acknowledge that:
- You understand the risks associated with beta or production software
- You understand CondoGrid does not verify developer data
- You release CondoGrid from liability for business outcomes
- You accept the limitations and disclaimers stated herein
